Terms and conditions
By placing an order, you agree to the Terms & Conditions from JPH Store / Elena Clothing. Please make sure you have read and understood the Terms before placing your order. The inclusion of any products or services on jphstore.nl at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.
We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on jphstore.nl at the time you place your order.
The prices displayed at jphstore.nl include country specific VAT and do not include delivery fees. The delivery fees will be added to your order and will be based on the country your order is shipped to. More information on our delivery fees per country can be found on the ‘Shipping & Returns’ page.
You will receive a confirmation by mail after placing your order, in case you have submitted your email address. You will be notified if we are unable to complete your order for any reason. In case we have already received a payment for such an order, we will attempt to refund the applicable amount using the same method that was used to make the payment.
If, for any reason, alternative arrangements are necessary, we will notify you and ask you to contact JPH Store to settle the refund.
JPH Store / Elena Clothing exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order in accordance with your selected delivery option.
After placing your order, you will receive a confirmation by mail including the delivery details. Your order is expected to arrive within 1-3 working days (for order within the Netherlands). Your order will be shipped by PostNL and shipping costs within the Netherlands are €3,95. Check the ‘Shipping & Returns’ page for more information.
You have the right to cancel your purchases without giving any reason within a period of 14 calendar days after the day of delivery. During this period the costumer will treat the product and its packaging with care.
During this period of 14 calendar days, you have the right to change your mind and send the items back in their original state and packaging. This will be without any obligations from your side, apart from the shipping fees to our store. In case you would like to return your item(s), the item(s) must be sent back undamaged and unused, as described on the ‘Shipping & Return’ page.
JPH Store / Elena Clothing will not be held responsible or liable in any way for its choice of shipping carrier.
We will provide a refund attempting to use the same method used to make the payment, as soon as possible and at the latest within 7 days of receiving your notice of cancellation, provided we have received the items or evidence of you having sent back the faulty items.
All consignments that are sent are insured by JPH / Elena Clothing. If you discover any damage to the package before opening, you must report this to the collection point where you picked up your consignment. If you have already opened the consignment when you discover the damage, please notify JPH Store immediately and return the item in accordance with section ‘Returns’ below. JPH Store will, for any products deemed defective, provide a full refund, including the costs of delivery and return. The provisions set forth herein do not limit any applicable statutory rights.
In the event of an error in connection with any products or services displayed through jphstore.nl (including typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability), JPH Store / Elena Clothing reserves the right to cancel any order prior to the time it is delivered to you.
JPH Store / Elena Clothing guarantees a full refund for any returned items provided that all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered or worn (other than trying it on) and that any labels or tags should be intact. Sale items cannot be returned.
All our parcels contain a return form for you to use if you decide to return any items.
Payment towards online store purchases can be made with a valid card by a provider accepted by jphstore.nl or with a PayPal account. The total order sum will be checked and reserved against your credit/debit card or marked as pending on your PayPal account until the time of dispatch from our store. Orders can only be processed via our webshop. We do not accept orders via email.
We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.
Nothing in these Terms shall exclude or limit JPH Store liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
JPH / Elena Clothing is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on jphstore.nl shall be limited to the total price of your order.
JPH Store/ Elena Clothing takes responsibility for all personal details that you submit to us or which we receive from you when you register for purchases. This information is used for signing and implementing the delivery contract and for managing the customer relationship that is set up as a result, including targeted marketing activities organised by JPH Store / Elena Clothing, collecting outstanding payments, fighting fraud and meeting legal obligations. JPH Store / Elena Clothing does not pass on any information to a third party. You can make a request to see the personal details that we have for you by emailing [email protected].
If there are defects in the goods you have purchased, JPH Store / Elena Clothing abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form and sticker.
JPH Store / Elena Clothing reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.
All rights, including copyrights at jphstore.nl remain with JPH Store. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without permission from JPH Store / Elena Clothing.
